Terms of Service

Last updated: [October 01, 2026]

These Terms govern your use of Whygone, a product of Alder Canopy LLC ("we," "us"). By using Whygone, you agree to these Terms.

AI / Output Disclaimer

Whygone uses automated tools to categorize and summarize customer feedback. All output is provided "AS IS" and may contain errors or omissions. You are responsible for independently reviewing any output before relying on it for business decisions. Whygone assumes no liability for actions taken based on its output.

End-User Data Responsibility

Whygone's exit-survey widget collects responses from your own end users (your customers). You are solely responsible for ensuring your own privacy policy discloses this data collection to your end users and that you have any consent required by applicable law (e.g. GDPR, CCPA) in your jurisdiction. Alder Canopy LLC acts as a data processor on your behalf for this data, not as the data controller.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ALDER CANOPY LLC, ITS FOUNDERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST CUSTOMERS, OR BUSINESS INTERRUPTION. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF YOUR USE OF THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnity

You agree to defend, indemnify, and hold harmless Alder Canopy LLC and its operators against any third-party claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your submission of content through it, or your violation of applicable law.

Third-Party Services

Whygone relies on third-party infrastructure providers, including Supabase (database), Vercel (hosting), and Stripe (payment processing). We are not responsible for outages, data handling, or errors originating from these providers, though we select and configure them in good faith.

Security

We use reasonable security measures appropriate to an early-stage product, but no system is completely secure. You acknowledge the Service is provided as-is with respect to security, and agree not to submit highly sensitive data (e.g. payment card numbers, government ID numbers) through it.

Eligibility

You must be at least 18 years old and authorized to bind the business you represent to use this Service.

Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, non-payment, or misuse. You may cancel your subscription at any time; no refunds are provided for partial billing periods unless required by law.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. Material changes will be communicated via email where practical.
